1. Acceptance of Terms

By accessing or using RacterMX ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Racter Holdings, LLC ("Company", "we", "us", or "our").

2. Description of Service

RacterMX provides email forwarding and alias management services. The Service allows you to:

• Create email aliases for your domains
• Forward emails to your real email address
• Manage DNS configuration and monitoring
• Configure privacy and security settings

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental consent
• Not use the Service for illegal purposes

You are responsible for all activity that occurs under your account.

4. Acceptable Use Policy

You agree NOT to use the Service to:

• Send spam, unsolicited emails, or bulk commercial messages
• Distribute malware, viruses, or harmful code
• Engage in phishing, fraud, or identity theft
• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, threaten, or abuse others
• Attempt to gain unauthorized access to systems
• Interfere with or disrupt the Service

Violation of this policy may result in immediate account termination without refund.

5. Subscription Plans and Billing

5.1 Plans: We offer Community (free), Professional, and Business subscription plans with different features and limits.

5.2 Payment: Paid plans are billed monthly or annually in advance. All fees are in U.S. dollars and non-refundable except as required by law or our refund policy.

5.3 Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date.

5.4 Cancellation: You may cancel anytime. Cancellation takes effect at the end of the current billing period.

5.5 Refunds: We offer a 30-day money-back guarantee for annual plans. Monthly subscriptions are non-refundable.

6. Service Limits

Each plan has specific limits on domains, aliases, and daily forwarding volume. Exceeding limits may result in:

• Delayed email delivery (queued until next day)
• Temporary service suspension
• Requirement to upgrade to a higher plan

We reserve the right to enforce reasonable limits to prevent abuse.

7. Privacy and Data

Our collection and use of personal information is governed by our Privacy Policy.

We use zero-knowledge architecture and do not store email content. See our What We Log page for details.

8. Intellectual Property

The Service, including all content, features, and functionality, is owned by Racter Holdings, LLC and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

9. Service Availability

9.1 Uptime: Professional and Business plans include a 99% uptime SLA. Community plan has no uptime guarantee.

9.2 Maintenance: We may perform scheduled maintenance with advance notice. Emergency maintenance may occur without notice.

9.3 No Warranty: The Service is provided "as is" without warranties of any kind, express or implied.

10. Limitation of Liability

To the maximum extent permitted by law, Racter Holdings, LLC shall not be liable for:

• Lost profits, data, or business opportunities
• Indirect, incidental, or consequential damages
• Service interruptions or data loss
• Third-party actions or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Racter Holdings, LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

12.1 By You: You may terminate your account at any time through the dashboard.

12.2 By Us: We may suspend or terminate your account for:

• Violation of these Terms
• Non-payment of fees
• Illegal activity or abuse
• Extended inactivity (free accounts)

12.3 Effect: Upon termination, your right to use the Service ceases immediately. Data may be deleted after 30 days.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or dashboard notice at least 30 days in advance.

Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Jurisdiction and Hosting

🇮🇸 Service Hosting: RacterMX infrastructure is hosted in Iceland, a jurisdiction with strong privacy protections and data sovereignty laws. Iceland's privacy-first legal framework provides enhanced protection for user data.

Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes shall be resolved in the state or federal courts located in Delaware.
